I feel that I am being harassed and discriminated at work, I have evidence which should prove such, but as far as I can see discrimination and harrassment is only based on certain criteria, such as- race, sex, color, national origin, religion, sexual orientation, age, political affiliation, disability or veteran status I want to know if discrimination and harassment can be based on other factors *besides* what is identified as "protected classes"

Although many employees call any type of harassment at work discrimination, you can only bring a lawsuit if the harassment is covered in a specific law. In New York, there is no law against generally unfair or unjust harassment unless you have a union, employment contract or government job.

If the behavior is EXTREME and CAUSES SEVERE EMOTIONAL DISTRESS many states recognize a common law claim of INTENTIONAL INFLICTION OF EMOTIONAL DISTRESS. I assume this is your supervisor you are speaking about. If so, contact an employment rights attorney in your locale who can give you more direct information on your legal options and most importantly, can give you legal counsel as to what you should do to document this, report this, and follow through with this.
