Working with an H1b now. getting married to a US citizen. Can I get an EAD after marriage and change jobs? How long will it take

I have H1B visa until 2014 with an employer, however my job situation is not stable. I'm getting married to my fiancee who is a US citizen this spring. After the marriage I am going to apply for a green card. When I am waiting for the approval for the Green card, can I apply for EAD and change my job? I am a finance specialist and it is not easy to find h1 jobs in my industry due to regulations preventing some companies to hire h1 workers. And I hope an EAD will help me in this situation even in the companies which do not sponsor h1 workers. And if it happens how long does it take to get EAD? Thanks

You can apply for an EAD if you have a pending adjustment application. You can use the EAD to work wherever you want, however it would end your H1b status. It takes 90 days to get an EAD.

Yes, once you apply for Adjustment of Status, assuming you are eligible otherwise, you can simultaneously apply for EAD and should receive it within 90 days. You can then use your EAD to get any job you want. I suggest you retain services of an immigration attorney who will guide you through this process. Good Luck.

You sould be able to file for permanent residence based on your marriage. The waiting time is not so long for EAD and hopefully you may hve your green card in hand before yoru H1 expires. Best Wishes! Lalita Haran 13295 Illinois st ste 128 Carmel IN 46032 Ph: (317) 660-6174 www.haranlaw.com
