Me and my son were target practicing one afternoon way out in the country. We were shooting targets when a man showed up and

said that we were hitting his house. About a mile away. Sheriff deputies arrived and interviewed me. But did not confiscate my weapon or issue me a citation. They let me go about a hour later. After 5 days has passed a detective contacted me and asked me questions and wanted me to come down and fill out a statement. I refused. He then said he would be handing it over to the District Attorneys office. If they charge me, what type of charge will it be and will it stick? The only evidence they have is pictures of the mans broken window. They do not have any of my bullets to match to my weapon. Just the fact that I was the only one down there at the time.
Consult with a few local Criminal Defense Attorneys. Most offer free initial consults.
Find a couple of attorneys on this website who are near to you and make an appointment to discuss your matter with them.
Good Luck!
More than likely, if the DA accepts the case and charges you, the charge will be Deadly Conduct.with a Firearm. Deadly conduct with a firearm is a third degree felony with a punishment range of not less than 2 nor more that 10 years in the penitentiary and a fine not to exceed $10,000.00. Do not talk to law enforcement, do not discuss your case on this open forum. Contact an attorney immediately and make arrangements for possible representation. If questioned by law enforcement demand an attorney and advise them that you are exercising your right to remain silent. Good Luck
You need to speak with a Lubbock criminal defense lawyer ASAP. Daniel "Danny" Hurley at Hurley and Guinn is a really good one.
When accused of a crime or suspected of a crime, the cops are not your friends.
You did the right thing by not making any further statements to the police. They could charge you with deadly conduct. An attorney may be able to convince the DA or a Grand Jury to reject the case. I would start shopping for an experienced defense attorney right away.
