Is spanking your child legal or not?

3 views 3 answers
My husband and I are splitting up. We currently still live in the same house. We have 3 boys ages 5, 6, 8. My husband does not spank the kids, and I do. He says that he is going to use that against me, and that he will get the primary parent because I spank them, and he uses "timeout". So anyways can I get in trouble for spanking them or not? I don't "beat" or abuse them. It's just discpline. Thanks!

You are allowed to spank your child as long as it does not cross the line to abuse. A spanking should not leave bruises. It sounds like you will have a high-conflict dissolution. Contact a local family law attorney ASAP.

You need to go and talk to a local atorney ASAP regarding these issues. It sounds like there are more facts here that need to be considered. Contact a local divorce atorney who has lots of expertise in child custody. I suggest you stop spanking the children now so it cannot continue to be an issue in your case. You might consult with a child psychologist or counselor as to alternative methods of disciplining your children. I have taken several cases to trial involving spanking and judges are all over the map on the issue. It is best to make it a non issue by just stopping the practice all together. You don't need endless legal bills to defend you nor do you want to lose the kids based on it.

Spanking is legal to the extent it isn't abuse. there is a fine line. Try some other form of correction or punishment. Also, one of your legal arguments is that if your spanking was so bad, why did he wait so long to do something about it? Why did he not take the kids away from you a long time ago to protect them?
