My husband was deported in 2005. He got a lifetime ban for conviction on Federal Student Aid Fraud (>$10K). Is US Visa possible?

He served 364 days in Federal prison, sentenced to 2 years probation, and ordered to pay damages of around $300K. He was deported to India soon after he finished his prison time. I have been working as a professional 5 months in the US, and spending 7 months in India with him. As we (and my parents) are getting older, the lifetime ban is becoming a growing hardship for everyone. We were married in 2002. He first came on a student visa, then overstayed.

He can apply now for a nonimigrant waiver. There is also a waiver available after 20 years outside of the U.S.

It seems that he has several problems.. First, he was convincted for a crime involving moral turpitude. Second, his overstay gives him a 10 year bar. He also probably wont get a non-immigrant visa since he overstayed his student visa, therefore will have a hard time proving non-immigrant intent. The best you can do is consult personally with an experienced immigration attorney to evaluate your options.
