If you are going to petition the court to open an estate and be appointed personal representative you should have an attorney who can help you with this process. If I were your attorney and I was concerned that your brother was going to object to your appointment I would serve him with a Petition for Administration which limits his time to object to 3 months.

I assume you have a lawyer to represent you in this matter, especially if you are expecting it to be contested. Your lawyer can answer this and explain the process to you.

Attorneys Gruskin and Lindquist are correct. It is absolutely vital that your Florida probate attorney take the necessary actions to limit your brother's opportunity to object to the admission of your father's Will and your appointment as Personal Representative. Good luck to you.

Your attorney can use what's called adjudication before issuance of letters. It will reduce the objection time for those properly served.
