1. When will this come off my credit report? 2. Can the bank sue me or sell this debt to a collections agency past the SOL?

I purchased a vehicle in Florida in May 2006, the vehicle was repossessed in Aug 2007, now the bank says I owe $20,000, this debt should come off my credit report after 7 years. The SOL for Florida is 5 years.

Here is a link that may be helpful as to how long derogatory information may be reported on our credit report, irrespective of the SOL. http://www.ohioconsumerhelp.com/sub/obsolete-CR... The bank can sell the account. But it would be a violation of the FDCPA for a collector to sue you on a time-barred debt. It would also give you a ground for dismissal if the bank pursued a claim on its own. If this happens, contact a consumer advocate. You have some great options in Florida (Steve Fahlgren - who is on this site, and Robert Murphy are two great advocates) All the best to you.

Generally, negative information can be reported for 7 years (and some information, like bankruptcy can be reported for 10 years). Understand that the statute of limitations is only a defense to a lawsuit. A collection agency, junk debt buyer may still harass you for collection long after the SOL has expired. The primary challenge with old debts is that the new collection agency or junk debt buyer will put a new negative entry on your credit report. You can dispute the entry, but it is a constant game. Most people prefer to actually solve their debt problems once and for all and file bankruptcy.
