Can a child born in the Philippines take her step father's surname after migrating to California?

In the Philippine Law the lawyer that I spoke to told me that I need to have an inter country adoption which is a very long process so my daughter can use her step father's surname and have her birth certificate changed legally. Her biological father is already dead so I won't have to worry about his consent. Since we are living in California with a Legal Permanent Resident status, what steps should I do to make everything legal? Can we do this in California and not do the inter country adoption?

If your new husband is a US Citizen, you should be able to complete a step-parent adoption in the US. Since your daughter's biological father is deceased, you will not have to terminate parental rights or obtain consent but you will need to prove the fact of his death. I recommend speaking to an attorney as the adoption process is complicated, especially considering the facts of your case. I just recently handled a step-parent adoption for a Russian-born child and would be happy to discuss your case with you. Please contact my office for a consultation.

If I were you, I would instead ask this question of an immigration attorney, since there might be nuances, rules and/or problems with changing one's name while on a green card. I do not do immigration law, so I cannot say.
