Anyway to keep D.U.I from showing up on background check?

14 views 6 answers
I was convicted of a D.U.I in 2008 in Cobb County Georgia, no accident involved or anything like that but I am currently searching for employment, and I am honest about this on all my applications and I'm pretty sure it is affecting my ability to obtain employment. I met all the requirements made by the court and have not been in any trouble since. Is there anyway to get this off my record or keep it from showing up on background checks. I don't think it is fair that one mistake is making it impossible for me to find employment.

Sorry, but you cannot get a conviction removed from your criminal history.

It wasn't one mistake. It was likely a string of them: you drank too much, then you drove, then you probably admitting drinking to the officer, then you probably took the roadside tests, then you probably took a breath test, then you probably tried to get by with the cheapest lawyer you could find. I'm just guessing, based on the string of mistakes most people make.

As the time for filing a Habeas challenge to your conviction has long since expired, I believe the only mechanism for removing this from your record would be to obtain a pardon from the Governor.

No. A 2008 DUI conviction is there for life.

The short answer is: NO. I have recently answered several question on .com concerning Expungements in Georgia. Georgia law DOES NOT ALLOW FOR A CRIMINAL CONVICTION to be removed from a Criminal History. Without being asked I believe your "one mistake" was not hiring an experienced and knowledgeable DUI Defense Attorney to represent you on the DUI case. Your best chance to avoid a conviction is to be represented by the best DUI Defense Attorney that is available to you ASAP! I have tried my best to let people know how important it is to avoid a criminal conviction in the first place. Unfortunately, this DUI conviction can follow you for years. I know this isn't the answer you were wanting to hear, but I believe it is accurate. Good Luck on the job hunt. George McCranie www.mccranielawfirm.com
