My mother died a yr before my grandmother. My uncle just settled and only wants to give us 1% of the awarded money. Do we have a case to sue for my mothers portion?

As your mom is deceased you should be entitled to her portion of your grandmothers estate. It may be easier to go and speak in person with a local probate attorney in your area. Most probate attorneys offer a free consultation. www.lawofficeofwilliamdaley.com

You are entitled to your mother's portion of the settlement. Consult an attorney ASAP to protect your rights.

Actually, the answer to your question is technical and dependent upon how your grandmother wrote her Will. Subject to the laws of Tennessee (which I leave to my TN colleagues to confirm or distinguish if different from what I have here written), if your grandmother bequeathed your mother a share of her estate "per capita" , then you would not be entitled to anything your mother would have otherwise gotten since your mother passed before your grandmother. However, if your grandmother's Will leaves a bequest to your mother "per stirpes", meaning by blood line of your mother, then you as your mother's child/children are entitled to whatever your mother would have gotten eventhough she died before your grandmother. You need to see the Will and not agree to anything before you do. As suggested, consult with an Estates Attorney in the State where your grandmother lived.

As the other attorneys have said;1) get your own attorney; and 2) Tennessee law controls. Since I don't know anything about Tennessee probate or wrongful death, getting a Tennessee lawyer is crucial.

Very likely that you do. I suggest you speak with a lawyer that handles wrongful death cases.
