I do not believe you need to get a divorce. However, keep in mind that you need to apply for asylum within one year after coming to the U.S. There are exceptions to this, such a change in country conditions, but the application is much more viable if you apply within the first year. -- LORIC, Immigration Solutions (Free Initial Consultation) Rodrigo Ivan Canido Managing Attorney 3333 Bowers Ave, Suite 130 Santa Clara, CA 95054 Tel: 650-279-5933 Email: [email protected] www.loric.net.in

You can apply within the first year of arrival, doesn't matter if you are still married or not. You do not have to be divorced. If you have been here for more than a year you can still apply but you face a high burden of proof as to why you filed late. Late filing can be only based on changed circumstances or extraordinary circumstances.

Unknown. It depends on the reason for the denial.
