When does the IRS respond with S corp status?

Business 4 views 3 answers
I incorporated in early February (the paperwork came back at the end of March). I sent in my S Corp request form via fax to the IRS office in Utah (per directions on the form) in early April. I have not heard back from the IRS (other than the fax confirmation note I received from my fax service). Do they send me a letter saying my corporation is an S corporation, or do I need to follow up with them?

They should send you a letter of acknowledgement. Remember, if you are on a calendar year you would have to have had this done by mid March in order to get credit for this tax year. You can always give them a call and inquire. Most of us here, including myself, offer a free phone consult. Best regards, Frank Natoli-Lapin, LLC (see Disclaimer)

From the IRS: After filing Form 2553, you should have received confirmation that Form 2553 was accepted. If you did not receive notification of acceptance or nonacceptance of the election within 2 months of filing Form 2553 (5 months if you checked box Q1 to request a letter ruling), take follow-up action by calling 1-800-829-4933. Do not file Form 1120S for any tax year before the year the election takes effect.

The IRS should have sent an acknowledgement of the election. If you have not received the acknowledgment, you should contact them to inquire.
