The first cause in the form complaint is for eviction. If that count was dismissed, then no eviction will be granted based upon this complaint. So the tenant does not have to vacate the premises. Just be sure to review the actual complaint to be sure the First Cause was for eviction and review the court's file to make sure that was the cause that was dismissed.
As Attorney Shaw has stated the first cause of action is usually the eviction. It is dismissed in most cases because the tenant has moved out after the suit was filed and before the actual hearing. The second cause of action is usually for the past due rent. If you are the tenant, then you need to make sure the eviction action was the first count or cause of action in the complaint. It is always best to consultation with Attorney to review the pleadings to protect your interest.
