College Student Charged with Misdemeanor for using Reduced Fare Metrocard

i'm a poor college Student with no job and i was arrested, charged with a misdemeanor for using a family member's reduce fare metrocard, which i did not know was illegal. This is the first time i've seen arrested or charged with any crimes. My question is on my DAT date, will i be "under oath"? Can they charge my family member for lending me the card? The arrested police said that they will just reduce it to a "voilation" which i thought was good until i got home and did some research and found out a violation is pretty bad too. The best case is an ACD correct? or something better? how i can get an ACD? do i have to plea guilty or not guilty? i heard an ACD was neither so how would i even get it in the first place, especially when they judge asks me to plea guilty or not guilty

If you are poor, you can have an attorney assigned, and s/he will answer these questions which include, yes, an ACD is the best thing next to an outright dismissal and your attorney can argue why you should get it. Plead not guilty when you are arraigned and ask for appointed counsel, if you qualify.

It is possible that you will receive an ACD. The family member who lent you the card has nothing to worry about. If you are eligible, the court will appoint an attorney who will represent you at no cost. Good luck.

No one is going after your family. If you are indigent the court will assign you a public defender.

You should plead not guilty and allow your attorney to work out a deal. An ACD is a good possibility and there is no reason why you would be "under oath".
