Does a speeding ticket violate my ACD?

Criminal Defense 6 views 6 answers
I received an ACD a couple of months ago for being in the park after dark and it's supposed clear sometime in September. However, I received a speeding ticket today and I'm worried that the ticket is going to affect my ACD. My question is; will my speeding ticket violate my ACD?

Not really, unless it is highly related to the ACD's charge, e.g. you had a speeding charge ACD'd two months ago, in which case the court can open the case even if the officer or prosecutor doesn't.

If this was in NYC the speeding ticket won't affect the acd.

It's very unlikely that receiving a speeding ticket will trigger the opening of the ACD.

It should not.

It shouldn't. Generally the only things that would actually trigger a violation of the ACD would be a new arrest or not living up to specific conditions of the ACD (ex: community service.) And don't forget: the DA has to actively reopen the old ACD case if they think you violated it. This often doesn't end up happening, especially in the city.
