Can a civil suit be filed against a non-custodial parent for violating a minor's right to privacy?

Business 5 views 3 answers
The non-custodial father has a child from another relationship. In court documents he recently filed, he provided exhibits exposing our daughter's mental and physical health issues to show that my relationship with the other mother is a detriment to their daughter, citing I am unfit because our daughter is suffering these illnesses. I never gave permission for him to use these documents and if our daughter found out he has exposed her to a public forum, she will be even more devastated. Can I file a formal civil complaint or something to have this action by him stricken? Thank you!

It's far from clear what "right to privacy" you think is present. It would be appropriate however, to limit access to a child's medical records to the parents and appropriate court personnel. The legal action to obtain that result will be a motion to seal the pleadings. Experienced family law counsel may well be able to accomplish that on an ex parte basis, or automatically under a procedural rule of the court. Best wishes for an outcome you can accept, and please remember to designate a best answer.

The child has no privacy rights. However these records should be sealed and made eyes for the court only. You do not have a law suit against him. As a parent he has the same rights regarding your daughter as you do.

I agree with both counsel. But really his assertions are a stretch
