I am the mother of a 5 Year old. Her Father has been in Jail and prison since I was just about a month pregnant. How do I get his rights terminated so my husband can adopt my daughter. Her real dad has never been there, has a bad criminal record mostly drug dist and robbery however some violent crimes too, and I am afraid for my daughter to be around him once he is released from prison. He has never been there for here and she does not know him. On the other hand I have been with my husband since my daughter was just shy of 6 months, I am a stay at home mom all the support comes from him, and he carries her on his health insurance. he is the only father she knows and she doesn't know of her bio father I think if the "bio father" steps in it would be devastating and confusing for her.

It should be possible to allow your husband to adopt your daughter. There are actually two possible routes. However, it is not a simple process and you would be well served by consulting with an experienced family law attorney.

Sounds like good man has stepped up to the plate. Good for you and your daughter!! That said, such adoptions are tricky. Dad needs to be notified and a hearing will be held. Your five year old is lucky to have a father figure in her life. Your husband may be able to adopt your daughter, but there are many steps to complete.
