My EB3 PD is OCT 2005. Labor, I140, and I485 has been filed. I-485 was filed in July 2007. we have done our Fingerprinting as well...
Last year I ported my PD to EB2 category, and received I140 approval on Dec 2012 . My priority date is current now and here are my questions
1. Should i file I-485 again?
2. Should i take the medical again?
3. Is there anything i need to do at this point other than waiting?
Please advise. Thanks!
No need to file a new I-485, but you do need to inform USCIS that the priority date is now current, include a copy of the new I-140 approval, and request the case be sent to Seattle for adjustment. They usually say that the district needs to request the file from NVC rather than NVC sending it at the applicant's request, so you might want an attorney to work with the Seattle office to ask them to request the file to go forward.
