Do half-siblings have visitation rights?

Business 5 views 2 answers
My husband (28) is not allowed to see his 9 year old half brother because his step father does not like him. The step-father is very controlling and jealous and uses this against my husband. When he (step-father) was in jail 2 years ago, my mother-in-law and brother-in-law and my family (myself, husband and two children) became very close however, as soon as he was released from prison, we were not allowed to speak to either one of them. Does my husband have any rights, as a brother, to visitation with his younger half brother?

No, I'm sorry, but P law does not yet have a law providing for sibling visitation rights. Perhaps your mother-in-law and sister-in-law can soften the stepfather's heart, but absent that, they won't be seeing each other. It's a sad situation. I feel for your husband. I agree with my colleague. This sounds like a very emotionally difficult situation but one without a legal remedy. Siblings have not automatic standing to pursue visitation and absent having cared for the child in the past or believing him to be substantial at risk of abuse, there is nothing that can be done.
