Bought house last year with hidden defects including well-owner knew, realtor helped. What type of attorney do I need?

Bought a house in Edgewater MD 1 year ago. Owner thought by waiving disclosure she was immune. Discovered $20K of defects -- most immediately, including well I replaced first week. Have proof that most were known and had prior issues. Believe realtor participated in hiding well issue and possibly others because she arranged inspection unbeknownst to me and forced me to use for "repair" (at settlement) related water company involved in the inspection. Home inspector missed all the big issues.

First of all -- it depends on the kinds of defects discovered. Did you have the opportunity to have a home inspection and then have a home inspection? If the defects were detectable and you opted not to inspect the property, then there may not be much you can do. However, if the defects discovered are those defects considered latent defects -- the kind that cannot be detected through a home inspection-- and the seller has knowledge, then you could take legal action against the former owner for fraud and for failure to disclose those latent defects as required by Maryland law. You could also have a potential action against the realtor as well.

I agree with my colleagues. You need a real estate litigator.

I'm handling a similar case at the moment where an existing defect wasn't disclosed on the required disclosure form, and there are several evidentiary, legal, and other issues that really require an attorney to help you sort through. Please call me if you'd like to discuss further as I may be able to provide assistance, or at a minimum referrals to several other excellent attorneys with extensive experience in this area.
