My husband has gone to a program called phenoix house in 2011 volentaraly after he got out of prison he has a alcohol and drug problem I am gathering all his paper work and getting a letter of recomendation for him to go back to the program. Is it possible for the d.a. and the judge to possibly consider this. He also took a drug program in county recently and is also getting a letter from the consuler there. We are hopeing that this might help his case. Is there any hope for us?

Follow your attorney's advice. The situation is dark because your husband needed to be perfect after prison and has committed a new crime. Entering Phoenix house is admirable, but probably can't save him from another prison term.

The court is looking for a change in behavior. The programs and the Phoenix house are a step in the right direction, but it didn't change his behavior so now the court is looking for a step up into a stricter program or incarceration. Five years is a great deal of time for this crime so obviously there's more to this matter. He needs a long term live-in program such as Delancey Street to even have a chance in persuading the judge. After you have a plan in place ask the court for an indicator.
