What happens if the judge did not show up in court and I plead no contest to a failure to yield ticket in Georgia?

I went to traffic court for an accident in which I got a ticket for failure to yield. I brought evidence that the other driver was at fault as well. The judge did not show up so the public attorney told everyone there options and if we chose guilty or nolo that their would be no fine since the judge did not appear. I did not get a chance to speak with him personally as he did not call me up. So I chose nolo because I was not sure if I could afford a trial. I am not sure if I did the right thing or if I should have went to trial for failure to yield. I do not think the accident was my fault but I was not sure I could prove it in court. Will the judge dismiss the ticket or will it be on my record? I am confused as to what happened in court.

If you plead Nolo to the accident the charge will be on your driving history, but you will not be assessed the 3 points which accompany the Failure to Yield ticket.

You probably did the right thing since a nolo plea can't be used against you in a civil action. Contact a local traffic ticket attorney to discuss this matter - most will offer free consultations.I feel fairly confident that since you entered that plea it will not be dismissed & will be on your record for motor vehicle department point count purposes. In the future always check with a local attorney before making any such legal decisions. Please note that I am a California attorney & not licensed or familiar with GA laws & court procedures.

If there was no Judge present when you entered the "plea," your "plea" was ineffective, a nullity. If you want to pursue the matter, hire an attorney to file a motion to set aside your plea, and follow his or her advice from there.
