I am the petitioner for my husband and need to fill I-864 (affidavit of support)...due to my studies this year i couldn't file my tax (zero)....but my brother (a LPR) is my household member and i m planning to keep him as joint sponsor(his tax return is good) by filling I-864 A i guess!!!!.........is it possible to do this or i need to have my tax filed or i won't be able to submit Affidavit of support?????.....please clearify me on this.....thanking you in advance!!!!!
The forms ask you whether or not you need to file taxes. Some LPR's don't need to file taxes because they are students or retired, or for other reasons. It is important that you co-sponsor be able to document his or her income and also confirm that the co-sponsor makes sufficient money to be able to add one person to their household. You also need to provide financial information for the past three years, so make sure that you can do that as well.
You need to file an affidavit of support regardless if you filed taxes. You can have a co-sponsor but make sure that they exceed the poverty guidelines by 125%. Consult an attorney.
Filing a tax return is not required in order to file an affidavit of support. Check I-864P to see whether your brother qualifies as a joint sponsor. It may be easier (and certainly safer) to do this using an immigration lawyer. You shouldn't use your husband as the proverbial guinea pig when his ability to live, work and build a life in the U.S. is at stake. My two cents.
