Hello, I was been given felony charges for Shoplifting in Dept store, merchandise in my cart stepped out by mistake. (Felt very sorry, too late) I went to court, worked with both Crim and Immig attorney, I was finally given Guilty of Trespassing (Misd), my immig attorney told Trespassing is not CIMT, and sentence was 175days in Jail and 175 days susp. This is back in 2011. I recently joined in a full time job, now I am planning on going to CANADA, for H1B VISA Stamping. ?- will there be any problem at US Consulate at visa interview or when I return back at POE( with DHS) ? I Just have paper of my conviction from the court. do I need to carry any opinion letter with me? Pls suggest/recommend, my Immigration attorney says I should be fine travelling. Any 2nd opinion pls? Thanks, joe

You attorney has all the facts and has seen the documents. No one here has. You should listen to him or her. If you're really concerned, request a simple explanation.

Felony 'charges', or felony 'conviction'? Conviction can be a big problem ... you have probably been fingerprinted and if you are not from Canada, DO NOT GO TO CANADA for a visa stamp. We can't give you a free 2nd opinion without looking at the court papers and the other attorney's opinion letter ... that's not fair to us ... nor is it fair to you.
