My tenant has developed a "need" for an additional hand rail on the inside stairs to their apartment.

There exists one already. But they may need additional assistance in the shower. The problem is the structure is 70 years plus old, and I want to keep in the "art deco" flavor. The walls are lath and plaster, and finding "studs" would be a problem and a great expense. Am I required?

I would make the accommodation. Otherwise, you might find yourself on the receiving end of a very expensive lawsuit of one variety or another. It is not difficult to find studs. An experienced contractor will have no difficulty. BTW, you should hire and pay for a licensed contractor and have the tenant approve the type of railing and its placement in writing, in advance. Good luck.

While I agree with Michael Dayude’s legal analysis and response to you. I just want to suggest a common sense solution. If it’s really going to be a pricey remedial effort you may want to offer to put a tenant into a nicer unit for the same price where you could easily accommodate the need. I don’t know what alternate unit you might have available, take a look.
