More details would be helpful but I would caution you against discussing the details of your case on any public forum such as this. Aggravating factors will vary depending on the charge. For example, in a DUI case, aggravating factors would include prior alcohol related offenses, a high BAC, causing an accident, being rude or disrespectful to the arresting officer and whether you refused the BAC. In a theft case, aggravating factors would include the dollar amount allegedly stolen, the vulnerability of the victim and any history of theft. There are too many possibilities to list out every possible aggravating factor for every crime but I would strongly suggest consulting with an experienced criminal defense attorney. Once you have shared the details of your case with an attorney, they can properly advise you of whether there are any aggravating factors in your case which will impact the plea bargaining process.
