I had 6 mm Stone near to right kidney size, when i had pain i went to the urlogist. He told me shock therepy is the best way to remove the stone that you have, after process is done he told my wife that we gave around 20 shocks and now stone will pass as powde,My followup appointmnet was scheduled after 2 week,I did my Xray one day before and next day Doctor told me you still have 4 mm stone which need to be remove through surgical process otherwise your kidney will be damage. My insurance covers most of the expense but I am woried as Body is mine and again I have to go through same process. Is that scnerio is common in kidney stone or my first treatment was not done properly. Also i am having good amount of pain after surgery due to shocks which i received, should i sue my doc and look another?

From a legal standpoint, it would appear the medical approach was to go the least invasive route, and if that did not work then and only then resort to the more drastic method of surgery. That sounds reasonable. A jury might think it sounds reasonable, too. As a lawyer, I cannot give you a medical solution here. But the law probably endorses this non invasive to more invasive approach.

Medical malpractice cases require expert review of records and opinion that the standard was not followed. How do you know the procedure was done improperly? Not everything succeeds. Also. These are costly cases so without extreme dage, it's unlikely there is a viable case. Talk to a lawyer to review options. Stephen L. Hoffman Law Office of Stephen L. It doesn't sound like a viable case on the info provided.

Having had the displeasure of having stones, the rule of thumb is that you can pass stones up to 5mm. The fact that they tried the lithotripsy is fine. It doesn't work all the time, and if it doesn't work, you either pass, or they remove surgically. You have nothing to sue your doctor for, let him remove it surgically and do not delay. The longer you wait the greater chance you have of developing hydronephrosis. The surgery is not bad, but you will have a stent in for about a week. Good luck to you.

An unsuccessful, noninvasive procedure does not necessarily mean that the procedure (lithotripsy) was performed negligently. Unfortunately, no result is ever guaranteed in a medical procedure. If you look at the consent form that you signed I think you will see that there was a sectioned that mentioned that the procedure might not be successful. It will also be very difficult to prove that the pain you feel is resulting from the procedure as opposed to the kidney stone itself. If you are feeling uncomfortable with this provider get a second opinion. What ever you decide you need to get the stone taken care of before it causes you to experience damage to your kidneys. Best to you and hope that you get your stones resolved soon.
