My position was eliminated due to a lack of work but I noticed today that they have posted my exact position. Is this legal?

I was laid off in the last month. My position was eliminated specifically due to not enough work. This was also the reason provided to the DOL. My former company is now posting to fill my exact position.

Generally, yes. In Georgia employees can be terminated for any or no reason, with few exceptions for such things as unlawful discrimination. Perhaps your employer was just making up what they thought was a neutral reason, when the real reason was they just wanted to replace you. Hard to know.

You are in an at will employment state and you can be fired for anyone reason or no reason at all. It is unfortunate that they were not honest with you about the reasons why. Maybe they were trying to spare your feelings.

BE THANKFUL THEY SAID LACK OF WORK WHEREAS YOU HAVE NO PROBLEM GETTING UNEMPLOYMENT . WHAT WAS THEIR REAL REASON? one of 2 things ; they wanted to hire someone for less money or they wanted to avoid having you stay long enough to qualify for some job related benefit like vacation pay, ins. etc............ or they were not happy with your work but wanted to male sure you got unemployment benefits ,,,,,,,,,,,,, now if it had anything to do with your religion or race that's different story
