Is this considered domestic violence?

I will be surrendering next week for domestic violence because of an altercation that took place last week. I will be finger printed, etc. My niece is reconsidering and wants to drop the charges. Can she do this or does this have to go to trial? Actually, I should have been the one to call police, as she struck me first and I struck back. She has a little scratch near her eyebrow and lied and said I hit her back with a chain. Will this be a felony, or will this be a misdemeanor? Will this go to trial? I have never been arrested. I am 60 yrs Of age.

I think you should talk to a defense attorney. If she is willing to tell the truth now, she should talk to the prosecution. You have a right to defend yourself. It should be a misdemeanor but it can be over-charged. It should go to trial if you do not receive an offer that is reasonable to you. Talk to a defense attorney.

Unfortunately, once the complaint is made, the police will take action. The DA will present the case and you will have a long drawn out fight, even if your niece no longer wishes to go forward, before the case gets ultimately dismissed. You definitely should speak to a criminal attorney even before surrendering to the police. That should be done with your counsel and you should make sure that you don't answer any questions that may incriminate you. Sometimes, what the lay person thinks is an innocent statement, ends up being what convicts them. Speak to an attorney asap.
