Can my EX husband stop paying Alimony if my boyfriend moves in with me?

My Ex-husband and I are just getting divorced right now. I am not employed. During our marriage did I raise our 4 children. My Ex ( who was very controlling) did not wanted me to go to work nor go to School. Also where we not able to hire a baby sitter financial wise if I would have gone to School. I only worked for about 4 years, there I only made enough money to pay the baby sitter. During summer month my bill was higher than my income. I had to quite the job because my inexpensive but great babysitter left. My Husband got another Masters degree during our marriage while I always took care of our children. He now makes a very, very good income. I am supposed to receive alimony for 3 years, my Ex husband agreed. What will happen if I move in with my boyfriend? I want to go to School!

It depends on the conditions for support in your decree.

Do you have an attorney for your divorce? Getting spousal support can be very tricky. It will be very hard to get if you do not have a lawyer that knows what they are doing. So, you should ask your lawyer these questions. Moving in with your boyfriend before the divorce is final may undercut your "need" for support from your husband. I would not recommend moving in with him until the divorce is final. Your lawyer can attempt to assist you in not having language in your decree that would stop any payments if you move in with someone. Good luck.

It depends on what your divorce decree states. If you want the support to continue, I would only put an end date but not a condition, such as remarriage. Usually boyfriends don't affect support since these relationships are not legally binding like a marriage.

It really depends on your divorce decree. If you're still in process of divorce watch out for what goes into decree. Alimony is called "spousal maintenance" in Texas and usually there is language saying it ends if you'"cohabitate" (fancy way of saying live with). You really need To be represented by an attorney. I would ask that your husband pay your attorney fees under the necessity principle.
