I was indicted for possession of marihuana over 4 ounces under 5 pounds. What should I do next?

This stems back to a motorcycle accident I was involved in in 2011, nothing was ever mentioned about drugs. I paid my tickets for failure to maintain speed and no motorcycle endorsement. Now 2 years later I got arrested as I was renewing my drivers license. They told me I had a warrant for felony possession. I thought it was some sort of mistake, but they took me to jail and showed me a grand jury indictment. How can I find out what these charges are about, and what kind of evidence they have against me? The night of my accident I was not given any tickets for drugs, or even asked any questions about it. How can they charge me 2 years later. I have a good job and a family now and I don't need a felony on my record and I don't want to go to jail.

I guess I will chime in with my colleagues and tell you to get a lawyer to help you. You obviously know something about the MJ since you know that it was from an accident in 2011. So, just because the PD did not arrest you at the time for the contraband does not mean the violation of the law does not exist. The questions regarding why they waited so long is something that your lawyer needs to find out and possibly fight for you in court. I am sure that if you get a good criminal lawyer, your fears of the unknown will dissipate.

Get a lawyer ASAP to try to find out when/where the alleged offense occurred. If you dont have any knowledge of what the charges are about, they might stem from a different event that you are unaware of. A lawyer can contact the district attorneys office and find out more about the case. Then you can work together to try to get you the best possible result.

Please get an attorney pronto to review your indictment and advise you on any criminal liability exposure. Once an indictment is issued, the statute of limitations is tolled - so no defense that it is an older charge. Go get that attorney!

Hire a lawyer to investigate. I don't see anything in your facts to show that this comes from a motorcycle accident. They may have charged you a year ago and you don't know it because you were just arrested. Hire your lawyer and let him look into it.
