46.04 is not designed to be a lesser included offense for Felon in Possession. Further, once a person is convicted of a crime, that offense stays with the person for the REST OF HIS/HER LIFE. It doesn't go away after a few years (like a declaration of bankruptcy in a credit report). Your husband needs a good criminal lawyer to explore all of his options, including the possibility of a trial. Seeking reduction of an offense should be something that he explores with his lawyer after investigation, discovery, and exhausting all of his OTHER options. Good luck.
