I'm going to court to fight a surcharge appeal on at fault accident, lawyers won't help me because I hit a truck when I hit black ice. My car was totaled, and his car was over 2,000.00 in damage. My driving record is going to be 10, after this accident so I probably will go into at risk car insurance. I have pics of the road I live on, elevation is 1100, I have win court paper from when I went in to fight the ticket the police gave me bald tires and marked lane violations, I have the weather radar of that day. I do I prepare myself? What will my insurance company come back at with me with? I want to be prepared. Suggestions? I called lawyers and there is no money involved in them for at afult accidents they won't help me. I understand.

Best advice I can give: forget about your record! You want to show the court that, at the time of THIS accident, you were driving reasonably. Highlight anything specific to the situation that will prove that. Driving slowly because of the weather? Say that. Maintaining a reasonable distance? Say that. Bring up whatever you can think of to show that you were doing your best to drive safely before hitting the black ice and that the black ice still caught you off guard. Maybe bring up the fact that a finding of fault will increase your rates, but honestly, courts tend not to be swayed by the "this is going to cost me money" line of arguments.
