Whenever someone has actually done something, the answer to the question, "Can they do that?", is self-evident. Clearly they can. The real question is, was that conduct legal? And, if not, what remedies may you have available? Persons engaged in debt collection are prohibited from discussing the debtor's affairs with third parties by the Fair Debt Collection Practices Act. In theory, violations are punishable by statutory damages of up to $1,000. But proving this happened can be difficult, and the violation doesn't erase the underlying debt, or prohibit the creditor from taking collections actions. You can talk to a debtors' rights attorney about the issue, but most likely, there are more important considerations in the grand scheme of things.
