My fiancé is at Rikers island his release date was oct 1st he's being held because he has a VOPB from Florida. The social worker said they can only hold him for 48 hours but some of the CO's there are saying he has to sit for 90 days. 48 hours should be midnight tonight and no one at the jail will answer my questions. How long can they legally hold him?

Up to 90 days. Usually it's about 30 days if they waive extradition

Has he waived extradition? I don't think 48 hours is the correct answer. If he doesn't waive extradition the DA has 90 days to get a govenors warrant.

Assuming no waiver of extradition, the foreign state if they wish to extradite has 90 days.
