i already have a previous one which i settled out and paid fine and no probation due to working out of the country. what are my consequences will i be able to get off if i pay all my fines and everything up front and take courses prior to going to court. i understand i have to go to court, but will it look good if i take my own initiative?
The counties may or may not find out about the other cases. I've seen it happen both ways. You will not "get off" by taking classes up front and paying fines off. There's no harm in taking the classes upfront and this does sometimes provide your attorney leverage in plea negotiations. Each case will stand on its own merits. DWIs are technical cases. I would hire an experienced attorney as soon as possible. Your ALR deadlines may have already expired. ALR hearings are an important first step in DWI defense, so your attorney will want to have those hearings if at all possible.
You should assume that each county will find out about the other, although it may not happen. It will help in both cases if you take the initiative to get an alcohol assessment and follow its recommendations. You are facing significant penalties either way and it's imperative that you retain experienced counsel for DUI matters ASAP.

More than likely they will discover the existence of the other although timing becomes an element and its possible one may be overlooked by another county. You didn't say exactly when you had the previous DWI but the date of that prior could be very relevant in how your driver's license is handled and the length and severity of the suspension, if applicable. Certainly anything you do seeking help can be considered and more than likely a prosecutor is going to assume you may have an alcohol problem with 3 DWI's, so taking the initiative could demonstrate that you are taking the situation seriously. DWI's are very fact-specific and an experienced lawyer can evaluate your case to determine the best course of actions and any available defenses. Just as a warning though, I would not expect to be able to simply pay a fine, take some classes and be done with it. Use the website to find a good attorney you are comfortable with and make sure they either handle both cases or communicate with each other should you hire different lawyers in different counties. Good luck to you!
