How can I kick out a roommate that had an agreement with an ex-roommate and pays no bills or rent?

Okay. Said roommate had a verbal agreement with an ex-roommate that is no longer with us. He told her that if she kept the house stocked with food, she wouldn't have to pay rent. Fast forward to now, she isn't living up to her agreement. The person she made the agreement with doesn't live here anymore and is legally off the lease. Before the two of them made that agreement, they didn't consult the other lease holders prior to her moving in. They allowed it only because she brought in must needed food. As of now, she isn't holding up to that agreement. She essentially lives here rent free. She isn't on the lease, nor does she pay a cent towards any apartment bills, like everyone else. The lease holders now want her out, seeing as she is sponging utilities. Is it legal to kick her out?

Certainly it is legal to kick her out - but you have to do it the right way, pursuant to a court order - and that may take some time and/or money. Consult with a local landlord-tenant attorney to be sure you do it correctly. Do it wrong - in any small way - and not only does she get to stay and you have to start over, but you could end up owing her damages, her court costs, and (at least here in Oregon - check out your own state laws) her attorney fees. You might also talk with the landlord and see if he/she is willing to help get rid of this squatter.
