Can I get a medical malpractice lawyer in Missouri if negligence occurred in Tennessee hospital?
Anonymous3 views6 answers
I live in St Louis, MO but my father passed away in a hospital in Tennessee due to possible failure to diagnose his acute GI bleed, the very same hospital where he had his monthly blood tests done for blood thinners. Can I get a lawyer in St. Louis and have them co-counsel with a lawyer in Tennessee or am I forced to pick a lawyer in Tennessee? And does that lawyer in Tennessee have to be in the same county as the hospital?
I'm really worried about having to choose a lawyer in the same county because it's a small town where the prestige are not plenty. I'm hoping there's a loophole. I want to do my father justice.
You can get an attorney in St. Louis and hopefully they know someone or can find someone good in Tennessee to serve as local counsel, and they do not have to be located in the exact county where the alleged malpractice occurred, although it would normally be preferred. Try 's "Find a Lawyer" service.

Since you will be dealing with state law and the negligence occurred in Tennessee, it is always advisable to hire a local lawyer admitted to practice law in that state.
You will need a lawyer licensed in TN, same county don't matter. You can hire an attorney in MO and he can either associate with a TN attorney to work the case or he can pro hac vice into TN. Your other option would be to find an attorney that is licensed in both states. I have a classmate that I went to law school with that is originally from TN, and is licensed in Mississippi and TN, he could represent you in TN and has no worry of small town conflicts. Some options like that would work for you.
Only a lawyer licensed in TN can handle the claim. Certainly you can hire a lawyer in St. Louis who can, as you put it co-counsel with someone in TN. In fact, the St. Louis lawyer can be "specially" admitted in TN to handle a particular case with the assistance of a TN lawyer. I've handled cases states in other states in that way. A lawyer would have to become "familiar" with the laws of that "new" state. Typically you would want a TN lawyer to handle the claim. The TN lawyer does not have to be from the same county.
A lawyer licensed in TN is necessary to file any action. Most medical neglience cases require filing suit. It is rare for the insurance carrier or provider to settle a claim without a suit being filed. Certainly a local lawyer could work with a TN firm and they could split the fee, if you have a viable claim. So if you know of a local lawyer that you are comfortable with who specializes in neglience (medical) contact them to have them help you to locate a TN lawyer.
