Camping..My husband just moved from AZ to PA met some guys. The guys invited him to go hang out at their campsite. 3 men total Chris (my bf) John (who invited my bf) and johns nephew Chris. Early in the night everything was okay. Started to get strange. John and Chris would come out of tent they would say they are seeing things long story short they were taking Bath Salts. Chris did not know this till after his arrest. Well john had about 5k on him and a bottle of percocets. That all went missing. Chris is a known thief and druggie so he was getting blamed well it started little Chris ended up sucker punching my bf and an altercation began. He filed a police report and went to ER he pass 3. My bf was charged w M-C 6 months jail. Is that legal? I need help so much2this story reifay68@aol.

The charge you are referring to seems to obviously be one of the variants of Simple Assault. Simple Assault is most commonly graded as a Misdemeanor 2 punishable by up to two (2) years incarceration. One of the exceptions to that is "mutual consent" in which both participants are fighting the other. This form is graded as a Misdemeanor 3 punishable by up to one year incarceration. It is NOT a felony. The interplay between this question and the one you posted after this one is not clear. This new charge may be the reason he is having a problem with Probation. I stand by my response to your other question with respect to both. He needs the assistance of counsel. The only lawyer who can really provide any help is one who "is on the ground" in your area. The Internet is not going to directly help your husband. Good luck.

I agree with Mr. Jones. Only someone who knows all of the facts, not just those you have posted, is going to be able to give the full advice that your husband needs.
