I'm being charged with criminal trespassing and theft in Colorado what's my maximum sentence

I took an I pod charger and a phone charger from an open top jeep. I was chased down by two kids who jumped me claiming citizens arrest ( is that legal?). They called the cops and held me down, when the cops got there one put his knee in my neck and arrested me. The cops didn't arrest the two or even detain them. I was held for a few hours but was never written a citation or any other form of paperwork saying I had committed a crime.

The maximum sentence for a class 2 misdemeanor (which sounds like one of your charges) is 12 months in the county jail, but the 1st degree trespass charge is a felony and can carry up to 18 months in state prison. However, you may not realistically be looking at jail time unless you have some criminal charges or convictions in the past, but you want to do everything you can to avoid the felony conviction because it will make it difficult to find work or a place to live in the future. Do you have an attorney yet? You certainly need one as your case may have defenses you're not aware of yet. Most attorneys, my firm included, offer free consultations, and I would be happy to speak with you further about your case.

If the Criminal Trespass is charged as a class 5 felony, it carries up to 3 years of potential prison, so this is a serious and you definitely need a good criminal defense attorney. You probably were not charged immediately because they have to turn it over to the DA's Office for them to file the felony - officers can only issues citations for misdemeanors. Many of us on offer free initial consultations. Mr. Greenwood is a good choice. Just shop around and find the right fit.

Your case could potentially escalate. There are 2 forms of Trespass. Misdemeanor and Felony. If you broke into a car then it will likely be a felony. Class 5 felonies are serious. While they presumptively carry 1-3 years prison, if you are on probation or bond on another felony that maximum sentence can be doubled. Now while it is not likely you receive a prison sentence (unless you have a serious prior criminal "rap sheet") you do not play with your future. Consider at least sitting down with an attorney for a free consultation.
