Federal Prisoner Civil Rights

Business 9 views 6 answers
I am inquiring on behalf of my friend who wants to know if he has any chance of winning this case that he filed Pro Se. The case is in reference to 2 defendants who had similar cases as himself. Yet they were sentenced below the mandatory minimum and he was not. I contacted several attorneys, only one responded saying that his complaint is not a civil rights matter, so what kind of complaint does he need to file?

Regrettably, it is impossible to answer your question based upon the limited information presented. If your friend is a defendant dissatisfied with the sentence imposed, it sounds like a criminal matter. However, it is unclear if your friend's remedy is by means of a direct or collateral appeal. Also, there is the question of whether or not your friend executed a valid waiver of his appeal rights as part of a plea agreement. Federal criminal appeals, whether direct or collateral, are an extremely specialized area of practice. Your friend should immediately consult with an experienced criminal defense attorney. If he cannot afford counsel, he should contact the Federal Defender's office. There are strict time limitations for filing the appeal. Good luck to your friend.

It is impossible to answer on this forum, without the benefit of a full review of the file. Your friend may not have qualified for safety valve relief due to his "leadership" role in the offense, his prior criminal record, his failure to tell the entire truth to the Government, etc.. Timing is important. Contact a local attorney or the local Federal Defender's Office for further assistance. Good luck.
