You can open a company in the U.S. through the assistance of an accountant. Any type of company (S Corp, C Corp, LLC, etc.) is acceptable for L1 purposes. The U.S. company can file an L1A petition requesting change of status from visitor to L1A (your family can receive L2 status) for you if it has a controlling interest in the Indian company, or vice-versa. The U.S. company should also be ready to do business, e.g., after incorporation, the company should lease office space and open a business checking account. It is OK if the U.S. company is a "new office" and currently has zero revenue and zero employees since it has the support of the Indian company. Your transfer from the Indian company to the U.S. company should not result in the Indian company shutting down. You probably have many questions. Please discuss with an attorney with experience in this type of visa category.

It might be possible ... as long as you're not the only employee. You should consult with an attorney ... most will charge a consultation fee. Search or www.ailalawyer.com

It is do-able. However more information is required about revenues, nature of business, your and company's objectives, etc. Ideally you will consult with an immigration attorney about these prospects.

Yes, you can obtain a change of status in the U.S. if your business documents can support an L-1 petition. However, a change of status is not a visa. A visa can only be obtained abroad. Your business and financial documents of the company in India must be reviewed. Also be aware that your Indian business must remain operational. The services of an immigration attorney are indispensable.
