What can I do to remove a criminal protective order ?

I was charged with stalking and had a CPO issued. I did not commit the crime I was accused of but had to plea since the victim was 17 at the time and the prosecution wanted to file other charges.. The victim would like to contact me but since the order is in effect doing so will send me to jail. She would like to remove this. How can we go about it?

DO NOT talk to her. Have NO contact with her. If she contacts you, IGNORE HER. It is a BAD idea to resume contact even if the CPO is removed. This is your life, don't risk it. That said, if you insist on having renewed contact, you need an attorney for sure, to take all possible steps to protect you from being accused of (and convicted of) further criminal activity. You cannot be the one interfacing with her especially while the CPO is in place.

I agree with the prior answer. You didn't "have to plead out"; you could have gone to trial, and taken your chances, but you didn't.. Now, if you have any contact with your victim, you're looking at serious trouble. Stay as far away from her as you can, unless you think you'll really enjoy jail.Don't speak to her, don't return her calls, and if you see her coming down the street, turn around and walk the other way.

It looks as if after reading two similar posts on this board that you were should have gone to trial on this case, sounds like people were conspiring against you on this one. Too late for that, contact a criminal defense lawyer to help you with the protective order.
