How can I change my preference category?
Anonymous5 views3 answers
My mother is a US citizen given a petition in july, 2010 to CA SVC under f1 family preference category. Now I got married and I and my wife is here on H1 visa. We notified uscis by mail with necessary docs. But they sent us back the docs and ups mail cutting. Still online status shows it is under nonmarried son category. How can I amke sure it belongs to married f3 category. Please help me.
I'd like to know the reason it was sent back. It could be because the file is no longer at CSC but no at the NVC. You need the receipt number, NVC case number, and a short clear letter requesting change in category from F1 to F3 due to marriage, and only include a copy of the marriage certificate. Don't complicate it by getting into current status etc. I'm sure an attorney would be happy to help you.
I agree. Your mom may have to take action at the National Visa Center, but you can call. You will need you and your mom's personal information (date of birth, full name). Have the I-130 petition in front of you. However, you may benefit from hiring an experienced immigration attorney. Good luck.
I am sorry to hear about your problem. You can have a local immigration lawyer investigate the situation. has an excellent "find a lawyer" tool to locate a top-rated attorney near you who offers a free consultation. Hopefully, somone here can help you get some direction.
