How can I change judges or venue

Child Support 5 views 4 answers
I have been disabled for more than 9yrs .My child support payment is about 65% of my SSD. I notified the court when I stop working but the judge refused to lower my support. Do I have a right to live when it was not joint decision to have a child. Each time that I have gone to court for a downward modification I received an increase. The judge is bias to 90% of the males who come before her because she is a woman scorn. I notified the court of my plight and was told that it was a conflict of interest for them to intervene. If cases that came before her were reviewed it would be quite clear of her bias. I have spoken to several clerks and they informed me of the pattern of her decisions. What can I do since it has placed my income in below poverty levels. I am not a deadbeat.

Your remedy if you disagree with any particular decision of a Magistrate is to filed an Objection appeal. The question is thus: has more than 35 days passed since you were mailed a copy of the last decision denying your downward modification petition? If so, then you are most likely precluded from filing an appeal at this point. That said, it may behoove you to schedule a consultation with a Bronx Child Support lawyer so you can learn why you keep losing.

If you really believe that the support magistrate was biased, you need to file a motion to have her taken off your case, however to do that, you need to have a case pending before the court. You should be aware that trying to prove bias or change support magistrates is next to impossible. Obtaining a downward modification based upon a disability that occurred 9 years ago would be a very difficult case if no change occurred since the last court order. You really need to have a consultation with an attorney to see if anything can be done on your case. In addition, as set forth by the other attorneys responding to your post, you need to file an objection (appeal) of any decision that you do not agree with. You have anywhere from 30 to 35 days to file depending upon how you were notified of the decision.

you need the aid of an attorney. If you can demonstrate that your income is below the poverty line, you can get a downward modification. however, if the magistrate in question is difficult you will need the aid of an attorney to do so.
