I'm in L1B VISA, I want to know what happen if my green card process is still on going but my VISA expires

My company starting the Green Card process for me, I heard the process is roughly as below: 1. Submit Labor Certification petition 2. long time wait for approve 3. Submit I-140 Immigrant Visa petition 4. long time wait because of backlog 5. Submit I-485 Adjustment Status 6. long time wait because of backlog 7. Get green card since there are three "long time wait" (step 2/4/6), so there is a risk that Green Card may not be able to issued before my VISA expires, I heard I can switch to H1B, but in case I can't get H1B, could you let me know what will happen if my L1B Visa expire during 3 long waits? Is it possible that I go back to my home country but not quite current Green Card process, then I stay 1 year and request for another L1, then go back to U.S. to continue the Green card process?

Yes, you got that one right: upon expiration of the L-1B max out period will need to go back to Hindustan, stay there one whole year, then return on an H-1B and open a "fresh' 6 year period, while waiting for your green card priority date to become current under the Hindustani quota. Once your I-140 is approved, you'll be able to extend your H-1B in 3 year increments until such time as your priority date becomes current and you are able to file for your green card application.

Please ask your employers immigration attorney or the attorney that processed your L1B. These are basic questions attorneys must answer and they know your case.

Second opinions should be rendered on . Who wants the liability? If you need a second opinion, hire an attorney and bring to that appointment your entire immigration record.
