Should I settle ? ( Workmen Compensation )

Bankruptcy and Debt 6 views 4 answers
First off I have two jobs - one full time and the other part time to provided for my family. The incident occurred in my part time job which is a RSTRNT job title " dish washer " As soon as I came in to work assuming my duties I slipped and fell on my back due to excess amount of water left on the floor left from the shift before me. I was sent to therapy through the restaurant's insurance and was advised to not carry more than 10lbs while assuming work duties. I only received 9 therapies and 4 doctor visits. The pain was minimized but not completely healed. I didn't not leave the jobs because as you already know I have a family to provide for and I didn't want to risk losing my full time. My lawyer wants to settle but I'm afraid that if the issue is not solved properly n can worsen.

I agree with Mr Bollinger. There are so many variables only your attorney can really answer this and help you determine what's best for you

What does your doctor say? If your doctor won't or can't tell you what is going on, have an orthopedic consult for your own peace of mind. If you do not have health insurance, you will have to pay for it. Your attorney is not a doctor and cannot make assurances you will nit get worse.

What is your diagnosis? Back strain/sprain? If so, you are essentially healed. If you have a disc injury, then that is a different scenario. Did you have a MRI? Did you have radicular symptoms? If all you had was a back sprain or strain, then your lawyer is almost certainly steering you in the best direction.

As the others have stated a lot depends on what the doctors have to say. If you are still in pain and the doctor is not suggesting anything you may want to consider changing doctors. This is something you should discuss with your attorney. If your attorney pushes you to settle I would suggest getting another opinion with a different attorney.
