How do I stop a garnishment immediately?

8 views 3 answers
My student loans were sold to sperate companies and while Ive been working with one company to make payments, I was unaware I even had a debt with the other company. The debt went unpaid for a year, and now they are garnishing my wages at a rate of 15% of may pay. I make very little money and I will be homeless very shortly if they keep this up. Their appeals process takes upto 120 days and I could very well be without a home by then. Is there any legal (and cheap) way to make this stop IMMEDIATELY, at the very least until I can have time to submit the required documents and have them evaluated. They have stated there is not.

The fastest way would be to file bankruptcy. By filing a Chapter 13 (assuming you are eligible), you would also get a lengthy period of repayment at an affordable rate. It's not cheap though; there is a $281 court filing fee plus you should have an attorney represent you to ensure it's done correctly. Some attorneys might be willing to receive their attorneys fees through the Chapter 13 Plan though. You can find a reputable bankruptcy attorney in your area by clicking on the Find A Lawyer tab. The other thing you might be able to do is assert whatever exemptions you are entitled to under MT law, but that will take time.

Agreed. Bankruptcy is the option here.
