Labeling and lodging of family law motion exhibits.

Business 7 views 2 answers
(1) Are lodged exhibits for a family motion labeled with letters A, B, C, etc. or with numbers 1, 2, 3. etc.? (2) Also, the local rules say exhibits may not be lodged earlier than 10 days before the hearing, but how does that affect serving of exhibits? Do I serve the other party right away with the exhibits anyway and then lodge them later with the court?

San Diego Superior Court Rule 5.5.2 Lodged Documents A. Exhibits filed or lodged by petitioner should be numbered. Exhibits filed or lodged by respondent should be lettered. . . . Yes, serve the documents as required by the Code of Civil Procedure without regard to when the Court wants them lodged.

Filing is not lodging, go ahead and serve the other party so that they can see what you have, failure might result in not being allowed to use the exhibits or a continuance both bad for you. Usually one side uses numbers and the other letters, in family law court, I doubt the judge will care that much which you use.
