My mother was in an assisted living facility and she died. The facility owes us over $2100 in rent refund and won't pay.

They admit to owing the money (over 2 months now) and say they owe some people who have been waiting 4 months. I was told that they have to prioritize and have had some unexpected expenses - broken pipes, etc., and don't have the money. How long can they hold the refund of her rent without penalty? Now they won't even take my call. I've contacted the Attorney General's office in PA but the on-line app says it takes 4 weeks to get to a complaint. What can I do?

It is either controlled by the contract under which your mother moved in or by state law. If you can find the contract that probably has your answer. If the estate of your mother has been taken out in probate court then it can sue, small claims probably being the appropriate court.. Good luck!

File a small claims case asap against them. This will get them talking. Do not let them push you around. It's enough already.

Because the value of the refund you are owed is roughly two thousand dollars, you would be best served to file a claim against the living facility in small claims court (Magistrate's office), either in the county were the original contract was signed, or in the alternative in the county that the Living Assistance Facility is located. It's always advisable to have an attorney represent you, but in this matter, since the amount of controversy is limited, make sure whatever attorney you intend to hire charges you reasonably and accordingly.

You should file in small claims court.
